EU Air Passenger Rights (EU Regulation 261/2004)

Your flight is officially considered to have been cancelled when you have a reservation but the flight was unable to take off.

You can make a claim for any delay of more than 3 hours. However, if you receive a re-routing option and the arrival delay does not exceed at least 2 hours then your compensation amount could be reduced by up to 50%.

If your arrival is delayed by at least 3 hours you are entitled to 250 Euros for a distance up to 1500km, 400 Euros for distances between 1500 km and 3500 km, and 600 Euros for distances of over 3500 km but only if one airport (departure or arrival) is not in the EU.

You may make a claim if you were not informed about the cancellation at least 14 days before the scheduled time of departure. If you were informed about the cancellation between 7 and 14 days before the scheduled time of departure and you were offered an alternative route which allowed you to depart no more than 2 hours before the scheduled time of departure and to reach your final destination less than 4 hours after the scheduled time of arrival, you are not entitled to a compensation. If you were informed about the cancellation less than 7 days before the scheduled time of departure and you were offered an alternative route which allowed you to depart no more than 1 hour before the scheduled time of departure and to reach your final destination no less than 2 hours after the scheduled time of arrival, you are not entitled to a compensation.

There are also several more complex rules which we have not included here at further length e.g. if your flight is cancelled and moved to a later date.

When the length of the delay is at least 5 hours, you should be offered a reimbursement of the ticket price and where applicable, a return flight to the first point of departure. If you are informed about the cancellation of your flight, the new flight times/dates however are unacceptable for you and the airline does not offer you a refund, you can use the Claim Flights Ticket Refund service (currently only available for Germany).

Know Your Cancelled Flight Rights:

In the event of a cancellation, the airline is responsible for providing passengers with the following:

  • A minimum of 2 telephone calls, fax, emails or messages
  • If you are provided with an alternative flight whereby the time of departure is delayed by 1-2 days (from the scheduled time of departure), the airline should provide you with hotel accommodation and transport between the airport and place of accommodation.

Other Important Facts About Flight Cancellation

You should be well familiar with the real reason for the flight cancellation, thus ensuring that it did not happen due to an "Act of God". Normal bad weather is not an "Act of God" whereas ice-rain or a thunderstorm would be considered to be an “Act of God”. Strikes are also recognized to be an “Act of God” however, if other airlines were able to continue their normal service, you are entitled to compensation resulting from a cancelled flight.
